Welcome to TruckLenders USA. These Terms of Service ("Terms") govern your use of our website, application system, and services (collectively, the "Services"). By accessing or using our Services, you agree to these Terms. If you do not agree, please do not use our Services.

1. Description of Services

TruckLenders USA provides a financing application platform for commercial vehicles and equipment. We work with brokers, lenders, and funding partners to evaluate and process your application.

We are not a direct lender and do not make credit decisions. Approval and funding are subject to review by third-party lenders.

2. Eligibility

To use our Services, you must:

• Be 18 years or older
• Provide truthful and accurate information
• Use the Services only for lawful business financing purposes

We reserve the right to refuse service for any reason.

3. Application Information

By submitting an application, you authorize us to:

• Collect personal, financial, and business information
• Share your application with affiliated lenders and funding partners
• Use secure automation tools (e.g., document analysis, AI-based scoring) to assist in review

You are responsible for ensuring the accuracy of all data submitted.

4. Text Messaging

By providing your phone number and opting in, you consent to receive calls and text messages (including automated and recurring messages) from TruckLenders USA about your application and financing options. Consent to receive text messages is not a condition of any purchase or financing. Message frequency varies and message and data rates may apply. Reply STOP at any time to opt out or HELP for help. See our Privacy Policy for details on how your mobile information is handled, including our commitment that mobile opt-in and consent information is never shared with third parties for their own marketing.

5. No Guarantee of Funding

Submitting an application does not guarantee approval, funding, or specific terms. Approval decisions are made by third-party lenders based on their underwriting criteria.

6. Document Uploads & Security

Uploaded documents (e.g., bank statements, ID, invoices) are:

• Encrypted using industry-standard methods (AES-256, KMS)
• Stored in secure AWS S3 or SharePoint environments
• Not shared outside of the financing process

You agree not to upload malicious or fraudulent files.

7. Account Access (for Brokers)

If you are a broker using our portal:

• You are responsible for maintaining confidentiality of your login credentials
• You agree not to share your account or impersonate others
• Access may be revoked at any time for misuse or policy violations

8. Intellectual Property

All content, branding, design, and software on our platform is owned by TruckLenders USA. You may not copy, reproduce, or reuse our materials without written consent.

9. Limitation of Liability

To the fullest extent permitted by law, TruckLenders USA is not liable for:

• Losses resulting from denial of funding or loan terms
• Damages from use or inability to use the Services
• Unauthorized access to your data (despite reasonable safeguards)

10. Third-Party Services

Our Services may rely on third-party platforms like:

• Salesforce (CRM)
• Amazon Web Services (cloud storage, encryption)
• Microsoft SharePoint (document storage)
• Amazon Cognito (authentication)

We are not responsible for issues arising from these third parties.

11. Governing Law

These Terms are governed by the laws of the State of California. Any disputes will be handled in the appropriate courts of Orange County, CA.

12. Changes to These Terms

We may update these Terms at any time. Continued use of the Services after changes indicates acceptance.
